App Store terms
If you download the app through Apple's App Store, Apple's standard End User License Agreement applies unless a custom EULA is provided in App Store Connect.
If you download the app through Google Play, Google Play's applicable terms also apply.
These Terms explain app-specific rules, paid features, support, and limitations.
Eligibility
You may use the app only if you are legally allowed to do so in your country and meet the age rating shown in the app store. The app is not directed to children. Adult or mature decks are labelled 18+ and are intended only for adults.
The app
Never Have I Ever: Card Game is a local party card game. One phone shows prompt cards, and the group decides how to answer. The app is for entertainment only. It does not provide medical, legal, financial, safety, emergency, gambling, alcohol, or professional advice.
The app should be played by consent. No card requires drinking, dares, harassment, dangerous behavior, illegal behavior, or explicit answers.
Free and paid features
The free version includes local play with free decks.
Paid Pro access may unlock premium decks and future deck drops while your subscription is active. If offered, a lifetime product unlocks premium access for the lifetime of the app/product, subject to app store rules, availability, and mandatory consumer rights.
We may change free and paid feature limits for future use, but changes will not remove mandatory consumer rights or access you have already paid for during an active subscription period.
Subscriptions and purchases
The app may offer weekly and annual auto-renewing subscriptions, and may offer a lifetime one-time purchase. Available products, billing periods, trial or introductory offers, and prices are shown in the app and in the App Store or Google Play purchase sheet before you buy.
- Payment is charged by Apple or Google through your app store account.
- Subscriptions renew automatically unless cancelled before the end of the current billing period under the app store's rules.
- You can manage or cancel subscriptions in your Apple App Store or Google Play account settings.
- Deleting the app does not cancel a subscription.
- If a free trial or introductory offer is available, the app store checkout screen will show the trial length, renewal price, and billing period.
- Access normally continues until the end of the paid period after cancellation, unless the app store or applicable law provides otherwise.
- Refunds are handled by Apple or Google unless applicable law requires another process.
The app does not use direct web checkout for digital content.
Restore purchases
If paid access is not available after purchase, use the app's Restore Purchases function with the same Apple ID or Google account used for the purchase. Contact hello@guba.studio if restore fails.
Accounts
The current app does not require or provide user accounts.
User content
The current app does not provide public profiles, chat, uploads, public sharing, or community features. If you email support or report a card, you are responsible for the content you send.
Acceptable use
You must not:
- misuse the app or interfere with its operation;
- reverse engineer or copy the app except where allowed by mandatory law;
- use the app for illegal, harmful, abusive, or unsafe purposes;
- harass, pressure, or endanger other players;
- bypass paywalls, subscription checks, or security measures;
- use automated scraping or abuse app APIs;
- upload or transmit malware or harmful code.
Intellectual property
The app, design, source code, brand, text, images, deck content, and other materials are owned by us or our licensors, except for content owned by users or third parties. You receive a limited, non-exclusive, non-transferable right to use the app for personal entertainment under these Terms and the applicable app store terms.
Third-party services
The app may depend on third-party services such as Apple, Google, RevenueCat, hosting providers, and other SDKs listed in our Privacy Policy. Third-party services may have their own terms and privacy policies.

Availability and changes
We aim to keep the app available and working, but we do not guarantee uninterrupted operation. We may update, improve, or discontinue features where reasonable. For paid features, we will respect mandatory consumer rights and app store rules.
Liability
Nothing in these Terms limits statutory consumer rights that cannot be limited under German or EU law.
Nothing in these Terms excludes liability for intent, gross negligence, injury to life, body, or health, product liability, guarantees, or other liability that cannot be excluded under mandatory law.
Subject to the previous paragraphs, we are liable for intent and gross negligence. For slight negligence, we are liable only for breach of essential contractual obligations, limited to foreseeable typical damages, unless mandatory law provides otherwise.
Withdrawal rights and app store process
Consumer withdrawal rights for digital content and digital services may depend on the app store checkout flow, the type of purchase, immediate access, and mandatory law. Cancellation, refund, and withdrawal handling usually happens through Apple or Google for app store purchases.
Dispute resolution
The European Online Dispute Resolution platform was discontinued on 2025-07-20, so these Terms do not include the old ODR platform link.
For Germany, the final VSBG consumer dispute-resolution statement should be added or confirmed before publication.
Governing law
These Terms are governed by the laws of Germany, without limiting mandatory consumer protection rights that apply in your country of residence.
